How long am I required to have the sr22? I got a DUI years ago. Im not sure if I still need it.

The Financial Responsibility Insurance or SR-22 is being used by the state to monitor the car insurance of problem drivers.

DUI or driving under the influence is considered a serious offense that is being classified as a violent crime in the state of Illinois. If you are convicted of DUI, this will permanently stay on your driving record. If you get arrested and/or convicted, you may fine, lose your driving privilege and be fined and/or be imprisoned. Repetitive convictions may result in bigger penalties.

After convictions of DUI , if you want to reinstate your license, the Secretary of State (SOS) monitors car insurance coverage, in the form of the SR22, for a certain period of time required by the law. The Illinois SOS does not say exactly the amount of time required to carry sr22 for each offense but the usual required time for for sr22 to be maintained in Illinois is at least 36 months (3 years).

To check how long you are required to maintain the SR-22 because of DUI conviction, contact the IL Secretary of State. They will be able to tell you how many years the SR22 is required and how to cancel it once the required period is up already.

I moved from Tennessee to Illinois. when I was still in Tennessee, I was required to carry an sr-22. Do I still have to continue it in my new location? Thank you.

Good question Raymond.

It is actually used differently in various states. Generally, an SR-22 insurance policy is a vehicle liability insurance policy that is required for restoring or reinstating after suspension or revocation of your drivers license. An SR-22 insurance is uniquely used for these kind of situations, because it is required by the insurance provider to inform the department of motor vehicles if the insurance policy is terminated, cancelled or lapses. Typically, if any of these things happen your license will be suspended until the insurance policy is brought current or has been reinstated. According the the laws of most states, you must purchase an SR-22 insurance for a certain period, usually three years, after the suspension or revocation has ended.

If you, for instance, apply for a drivers license in a different state, you will likely have to continue with the SR22 insurance policy. You may also contact the DMV in Tennessee and Illinois to make sure if it is still required for you to carry the SR22.

Q: A friend of mine borrowed my car and wrecked it and she says she has Chicago SR-22 insurance. Will it cover the damages?

A: The car insurance typically follows the car and not the driver, so the insurance that would kick in, regardless of the driver and whether they have Chicago SR-22 insurance or not, would be yours, since it’s your car.

However, if you exhaust your coverage–like if the damages are $15,000 and you don’t have that much coverage–then the Chicago SR-22 insurance coverage of your friend will kick in to cover the remainder. Your rates may still go up.

Q: I’m from St Paul, but I’m moving to Austin. Do I still need my St Paul SR22 insurance?

A: Even though you’re moving to a new state, and you’ll be getting a license in that new state so it would seem that you wouldn’t have to comply with any license restrictions from your old state, St Paul SR22 insurance is different. You need to continue meeting the requirements of your St Paul SR22 even while you live in Austin until the period of SR22 filing is up.
